TRIBE Insights – Terms of Service

Welcome to TRIBE Insights. These Terms of Use (the “Terms”) are a legal agreement between TRIBE Insights, an Illinois nonprofit organization with a mailing address at 901 Lake St., Unit 3331, Oak Park, IL 60303 USA (“TRIBE Insights,” “we,” “us,” or “our”) and any person who accesses or uses:
•the website located at www.tribesights.org (the “Website”), and
•any other websites, applications, online communities, courses, events, or services we own or operate (together with the Website, the “Services”).
By accessing, browsing, or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, do not use the Services.
If you access the Services from outside the United States, you are responsible for compliance with your local laws. By providing personal information to TRIBE Insights, you understand that your information will be transferred to and processed in the United States, which may have different data-protection laws than your country of residence.
1. Eligibility
You must be at least 18 years old (or the age of majority where you live, if higher) to use the Services. By using the Services, you represent and warrant that you meet this requirement and that you have the authority to agree to these Terms. If you are using the Services on behalf of an organization, you represent and warrant that you are authorized to bind that organization to these Terms.
2. Changes to the Services and These Terms
TRIBE Insights may modify, suspend, or discontinue any part of the Services at any time, with or without notice.We may also update these Terms from time to time. When we do, we will change the “Last updated” date above. Your continued use of the Services after we post changes constitutes your acceptance of those changes. Please review these Terms regularly.
3. Privacy Policy & Communications
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully for details about how we collect, use, and safeguard your personal information.By using the Services, you agree that we may contact you via email, in-platform messaging, or (where you have opted in) SMS/text messaging about your account, program participation, events, and other mission-aligned information. You can opt out of certain communications as described in our Privacy Policy and in the messages we send.
4. Accounts, Registration, and Security
Some features of the Services may require you to create an account or profile. When you register, you agree to:
•Provide accurate, current, and complete information;
•Maintain and promptly update your information as needed;
•Keep your login credentials confidential and not share your account with others;
•Notify us immediately of any unauthorized use of your account or any security breach.
You are responsible for all activities that occur under your account. TRIBE Insights is not liable for any loss or damage arising from your failure to safeguard your account credentials.
5. Acceptable Use and Prohibited ConductYou agree to use the Services only for lawful purposes and in a way that is consistent with our mission to support entrepreneurs, leaders, and communities. Without limiting the foregoing, you agree not to:
1.Harass, threaten, or harm others
Stalk, harass, intimidate, or otherwise abuse any person. Send, post, or share content that is hateful, discriminatory, defamatory, obscene, pornographic, or otherwise offensive.
2.Engage in abuse, discrimination, or harmful content
oPost content that is racist, sexist, homophobic, transphobic, or otherwise discriminatory.
oPromote or depict violence, exploitation, or harm to any person, including children.
3.Engage in unlawful or fraudulent activity
oUse the Services for any illegal purpose or to encourage illegal activity.
oEngage in fraud, misrepresentation, or other deceptive practices.
4.Impersonation and misrepresentation
oImpersonate any person or entity, including TRIBE Insights staff or partners.
oMisrepresent your affiliation with any person or organization.oMisrepresent the source or ownership of content you post.
5.Unsolicited commercial communications & spamoUse the Services to make unsolicited or inappropriate offers, advertisements, or promotions.oSend spam, chain letters, or pyramid schemes.
6.Intellectual property violationsoPost content that you do not have the right to share.oInfringe any copyright, trademark, trade secret, right of publicity, or other proprietary rights of others.
7.Technical misuseoInterfere with or disrupt the operation of the Services, servers, or networks.
oIntroduce viruses, malware, or other harmful code.oAttempt to gain unauthorized access to any part of the Services or related systems.
oReverse engineer, decompile, or attempt to derive the source code of any part of the Services, except where permitted by applicable law.
8.Misuse of community featuresoUse community spaces or discussion features for purposes unrelated to the community or topic.
oPost content primarily intended to manipulate, mislead, or create a false impression (e.g., fake testimonials, astroturfing, coordinated manipulation campaigns).We reserve the right (but have no obligation) to remove content, suspend accounts, or take any other action we deem appropriate if, in our sole discretion, we believe that your conduct violates these Terms, our mission, or applicable law.
6. User Content and License Grant
“User Content” means any content you submit, post, upload, or otherwise make available via the Services, including profiles, comments, posts, messages, survey responses, chat content, and materials shared in events or communities. You retain ownership of your User Content, subject to the rights granted below. By submitting User Content through the Services, you grant TRIBE Insights a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and perform such User Content in connection with operating, improving, promoting, and documenting the Services and our nonprofit mission (for example, showcasing community success stories, anonymized case studies, or aggregated insights).Where appropriate, we will seek to use User Content in aggregated, anonymized, or de-identified form, especially for research and reporting purposes.
You represent and warrant that:
•You have all necessary rights to grant the above license;
•Your User Content and your use of the Services do not violate any law or the rights of any third party; and
•You will not submit any User Content that is unlawful, harmful, or otherwise violates these Terms.
We may, in our sole discretion, remove or refuse to post any User Content that we believe violates these Terms, our mission, or applicable law.
7. Intellectual Property and OwnershipExcept for User Content, all materials on or forming part of the Services—including text, graphics, logos, icons, images, audio and video clips, course materials, designs, software, and the compilation of these elements—are owned by or licensed to TRIBE Insights and are protected by copyright, trademark, and other intellectual property laws.“TRIBE Insights,” the TRIBE Insights logos, and any related names (e.g., Launchpad Entrepreneur Academy), marks, and design elements are trademarks or service marks of TRIBE Insights. You may not use our trademarks without our prior written consent.Subject to your compliance with these Terms, TRIBE Insights grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for your personal, non-commercial, mission-aligned use (for example, your own learning and business development), unless a separate written agreement allows broader use. You may not:
•Copy, reproduce, modify, distribute, or create derivative works of the Services or any content (other than your own User Content) without our prior written consent, except as expressly permitted by the Services (e.g., downloads provided for your personal use).
•Remove any copyright, trademark, or other proprietary notices.
8. Third-Party Content, Links, and Tools
The Services may include links to third-party websites, resources, tools, or services that are not owned or controlled by TRIBE Insights. We do not endorse or assume responsibility for any third-party sites or services, or their content, privacy practices, or terms. If you access any third-party site or service, you do so at your own risk and subject to that third party’s terms and policies. Some content on the Services may be provided by other users, partners, or third parties. TRIBE Insights does not endorse, guarantee, or assume responsibility for the accuracy or completeness of any third-party or user-generated content.
9. Payments, Donations, and Paid Programs
Some portions of the Services may be offered for a fee (for example, courses, cohorts, workshops, events, or premium content). Fees, refund policies, and any program-specific terms will be disclosed at the point of purchase or registration.By submitting payment information, you represent and warrant that you are authorized to use the payment method provided and authorize us (and our third-party payment processors) to charge the applicable amount. Unless otherwise stated at the time of purchase:
•Fees and donations are generally non-refundable, except where required by law or where we explicitly state a refund policy.
•We may change our pricing or offerings from time to time, but such changes will not affect charges already incurred.
10. Educational and Informational Nature of the Services
The content and programs offered through the Services are for educational, informational, and community-building purposes only.Nothing on the Services should be construed as:
•Legal, tax, or financial advice;
•Mental health or medical advice;
•Professional consulting tailored to your specific circumstances, unless expressly agreed in a separate written agreement. You are responsible for your own decisions and for seeking advice from appropriate professionals before acting on information obtained through the Services.

11. Disclaimers
To the fullest extent permitted by law, the Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Without limiting the foregoing, TRIBE Insights does not warrant that:
•The Services will be uninterrupted, secure, or error-free;
•Any defects will be corrected;
•The Services or servers are free of viruses or other harmful components; or
•The information available through the Services is accurate, complete, or current.
You use the Services at your own risk.
12. Limitation of Liability
To the maximum extent permitted by law, TRIBE Insights and its directors, officers, employees, volunteers, agents, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with:
•Your use of or inability to use the Services;
•Any content or conduct of any third party on the Services;
•Any unauthorized access to or use of our servers or any personal information stored therein; or
•Any other matter relating to the Services.
In no event will TRIBE Insights’ total liability to you for all claims arising out of or related to the Services exceed the amount you paid to TRIBE Insights for access to the specific Service giving rise to the claim in the twelve (12) months prior to the event or circumstances giving rise to the claim, or one hundred U.S. dollars (US $100), whichever is greater.Some jurisdictions do not allow limitations of certain damages, so some of the above limitations may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless TRIBE Insights and its directors, officers, employees, volunteers, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:
•Your use of the Services;
•Your violation of these Terms or any applicable law; or
•Your User Content or your infringement of any third party’s rights.
We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which case you agree to cooperate with our defense.
14. Termination and SuspensionWe may, in our sole discretion and without notice, suspend or terminate your access to the Services (or any portion thereof) for any reason, including but not limited to:
•Violation of these Terms or our policies;
•Conduct that we believe is harmful to TRIBE Insights, our community, or others; or
•Technical or security issues.
You may stop using the Services at any time. Sections that by their nature should survive termination (including, but not limited to, User Content license, intellectual property, disclaimers, limitations of liability, and indemnification) will remain in effect.
15. Governing Law and Dispute Resolution
These Terms and your use of the Services are governed by the laws of the State of Illinois, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in Cook County, Illinois, and you consent to the personal jurisdiction and venue of such courts.
16. DMCA / Copyright Complaints
If you believe that any content on the Services infringes your copyright, you may notify us by providing a written notice that includes the information required under the Digital Millennium Copyright Act (DMCA), including:
•Your contact information;
•Identification of the copyrighted work claimed to have been infringed;
•Identification of the allegedly infringing content and its location on the Services;
•A statement that you have a good-faith belief that use of the material is not authorized;
•A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf; and
•Your physical or electronic signature.

17. Miscellaneous
•Entire Agreement. These Terms, together with our Privacy Policy and any additional terms or policies referenced herein, constitute the entire agreement between you and TRIBE Insights regarding the Services.
•Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
•No Waiver. Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
•Assignment. You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms without restriction, consistent with our nonprofit mission and applicable law.
